Bismillahi was salaatu was salaamu alaa rasulilah
Not too long ago the Shaykh Muhammad al-Banna gave a talk and he took some questions. One of the questions was which Imaam do we follow. The shaykh answered that the leader that we follow and fight behind is the ruler that rules over a land. He said that the prophets (alayhimus salaam) were not allowed to wage jihaad without rule or a ruler. And he mentioned the ayah in the Qur'an where the people after Musa said, "Appoint for us a king, that we May fight in the cause of Allah." (2:246). And the Prophet (sallaallahu alayhi wassalaam) was not allowed to fight until he had leadership Madinah. He stayed in Makkah for 13 years under much oppression without an order to fight.
Along the lines of jihaad, Allah (ta'alaa) told the believers in the Qur'an: "And make ready against them all you can of quwwah (power/might), including steeds of war…" (8:60)
And the Prophet (sallaallahu alayhi wassalaam) mentioned in Saheeh Muslim that the quwwah mentioned in the ayah means archery. The best thing at that time was the horseback and archery and spears. So we would have to prepare what is comparable today.
Then Allah (ta'alaa) told the believers in the Qur'an: "O Prophet! rouse the Believers to the fight. If there are twenty amongst you, patient and persevering, they will vanquish two hundred: if a hundred, they will vanquish a thousand of the Unbelievers: for these are a people without understanding. For the present, Allah has lightened your (task), for He knows that there is a weakness in you: But (even so), if there are a hundred of you, patient and persevering, they will vanquish two hundred, and if a thousand, they will vanquish two thousand, with the leave of Allah: for Allah is with those who patiently persevere." (8:65)
Meaning that at best, the companions can prevail against a 10:1 ratio, and if they are weak, then they can prevail against a 2:1 ratio.
So with this, the Shaykh mentions 3 conditions for jihaad:
1.) There must be a ruler
2.) The Muslims must have quwwah (strength) by way of weapons and vehicles/vessels
3.) The Muslims must have at least half the numbers of the kuffaar, i.e. 1:2 ratio
Then the Shaykh went on to say based on this that there is no jihaad in Filisteen. And he asked why did Allah (ta'alaa) make jihaad obligatory? As Allah says in the Qur'an that the believers, they are to fight in the cause of Allah, whereas the disbelievers fight for the sake of Taghuut. The fighting prescribed is so that fitnah is removed and that the deen is all to Allah. So the fighting in Palestine, is it removing the fitnah or is it causing the fitnah? Is it even reducing the fitnah, or is it adding to the fitnah?
The shaykh then said no honor, no victory, and no success will occur until the Muslims return to the way of the companions. And until we return to the Qur'an and Sunnah and the way of the companions we will not have what Allah promised.
Then the shaykh quoted the ayah: "When angels take the souls of those who die in sin against their souls, they say: "In what (plight) Were you?" They reply: "Weak and oppressed Were we in the earth." They say: "Was not the earth of Allah spacious enough for you to move yourselves away (From evil)?" Such men will find their abode in Hell,- What an evil refuge! - Except those who are (really) weak and oppressed - men, women, and children - who have no means in their power, nor (a guide-post) to their way."
So it is upon those with the ability and the strength to flee from that situation except those who are really weak and cannot do so. They are in such a humiliating position that they can't even get water without going to the Jews. For them is to make hijrah from this position of oppression and lowliness until they can fulfill the three aforementioned criteria and have the quwwah to fight. Wallahu 'Alim
