View Full Version : Filing criminal case against Uzbek goverment
Is it possible to file a criminal case against the uzbek officials that are involved in the massacre of the innocent lives in Uzbekistan for the last 15 yrs? If such case is filed in several countries, that would limit their exile options to russia and middle east. Most of the civilised world have extradition treaties between them. The only thing that I am not sure whether foriegn local courts will consider these cases or not.

yes it is now. You can file a law suit against government people if they commit crimes against humanity and/or war crimes. International Criminal Court is the court you can do so. I think Uzb-n is party to it.
Previously, some domestic courts in some countries like in Belguim could sue politicians from other coutries for such crimes, huge case against Ariel Sharon was dropped unfortunately.
You can also file a law suit against Uzbek government officials in the US under Alien Torts Act which allow to sue (for civil liability) foreign officials for human rights abuses when they set their foot on American ground. The law is archaic but was revived recently and there were quite a few precedents since 1990s, and the law is very functional now. Most importantly, any individual who had suffered abuse can file a law suit. So if there are any Andijanis in the US - you could sue the gov-t for millions for the Andijan massacre or any other human rights abuse you may have suffered in Uzb-n. I can send more info on the Act for whoever is interested.

I have checked and it looks Uzb-n is a party to the Rome Statute of ICC. It may have not yet ratified it yet. But in any case ICC is functioning now from 2003, and it will have universal jurisdiction, apart from the US, but it seems it may change soon.
In regards to the US, Uzb-n, along with a dozen tiny countries, signed a bilateral treaty with the US not to extradite US soldiers to ICC under strong pursuasion from Washington, it is called impunity agreement. This is just another reason why Bush is very pleased with Uzb-n...
