hey guyz...

Does anyone knows or have got a green card through his/her employer? what is the procedure? how long will it take? should I have a lawyer? what are my chances?

I'd appreciate any advice.

Yankee, if you have an employer you should talk to him/her first. If it is a big company they know their ways around. Some companies do not do it regardless anything. If your company agrees to sponsor your green card their lawyers will act on your behalf.

This is a small company 15 people, and they've never done it before and my manager would like me to stay at his company as long as i can...the company doesn't have any lawyer, and it is sole proprietership

In this case you have to hire a lawyer to ensure that everything goes fine. Make sure you hire a good one with good portfolio. They do charge a pretty decent amount but again you have to be very careful while chosing a lawyer.

If your employer is willing to sponsor the green card, lawyer should tell you what paperwork you need to bring. One thing for sure, it will take about 4-5 years for you to be able to recieve your permanent green card thru your employment.

I can copy/paste a brief overview of the case. It certainly is similar to what you do in order to obtain H1-B.

STEP 1 - Apply for Labor Certification with the Department of Labor.
To obtain an approved Labor Certification, the employer must prove (through newspaper advertising) that they were unsuccessful in recruiting enough qualified workers for a certain position.


The employer may apply through Regular Labor Certification, or Reduction in Recruitment Labor Certification.

Regular Labor Certification processing involves filing the DOL forms ETA 750A and ETA 750B and waiting for advertising instructions from the Department of Labor.

Processing time for Regular Labor Certification varies between 1 to 3 years.
Reduction in Recruitment Labor Certification is where the employer shows the DOL that they have already UNSUCCESSFULLY attempted to recruit U.S. workers for the position. The DOL likes to see a consistent pattern of recruiting for the 6 months prior to filing, although in many cases one three consecutive day advertisement (including Sunday) in a major newspaper is sufficient. Newspaper advertising is the strongest form of evidence. Internet postings, job fairs, headhunters, etc., provide good supporting evidence.
Processing time for Reduction in Recruitment Labor Certification varies between 3 to 8 months.

STEP 2 - Once the employer has received an approved Labor Certification, they may apply to the BCIS with the Form I-140, Immigrant Petition For Alien Worker.
The foreign national may include his or her family (spouse and children) on the I-140. Processing time for the I-140 is 3 to 8 months.

STEP 3 - Once the employer has received an approved I-140 petition, the next step is for the foreign national to apply for Adjustment of Status.
After the foreign national applies for Adjustment of Status, he or she (and the spouse and children) will receive work authorization and advance parole (re-entry permit after foreign travel) within 90 days. He or she will then have an interview for the Green Card in 6-36 months.

The foreign national and his or her spouse and children will receive the Green Cards (permanent residence) upon successful completion of the interview.

one little thing, does anyone in California (Burbank, Los-Angeles) have a GOOD lawyer not those hillbilly lawyuers, i need good decent one

Since when is a BAR exam more favorable towards hillbillies? :?

Do you know that there are organizations that provide FREE legal counseling? Many of the folks who work there are lawyers, or future lawyers. Schedule an appointment with one of them. You will at least get a basic idea, all free of charge.

Eeeh, you cannot imagine what hillbillies you can meet out there. I lost overall $2000.00 on one of those. It is not that they dont want to take care of your case (sometimes they dont) simply they chose what is "more" important to them. This way some cases get so neglected, no curtesy twards client what so ever.

Ask Uzbeks/Russians/Jews or anyone who have such a case ior simular case with specificly specialized in immigration case lawyer.

Otherwise Your case would be denied and Your money is wasted >>>> ....
must of all is a time You loose.

So talk lots other people regarding that, You need not only second opinion You need 15 opinions in this case to achchieve Your goal.
