Dobrii Den’ Forumchani,

U menia takaia problema: My OPT expires this coming December and the company I am working for does not issue H1-B visas to any of its employees.
However, when I started working for them I did not provide them with my working permit card (OPT, they did not ask for it), so basically the company I am working for thinks that I am the US citizen.
So my question is:
Does anyone know what would happen if I keep working for the company without telling about my OPT expiration situation?
Is there any way they can find out about it? What about USCIS?

In my opinion, they won’t find out, unless I tell them myself. Am I right?

Simple, if they find out, you are screwed :) If company made a mistake in the begining they probably will try to take it as smooth as they can. Simply, they will fire you.

Working without a permit and legal documents is a serious matter. It will upset BCIS/USCIS badly. Don't cross your chances for a better future. Take care of your paperwork.

About not telling them I am not sure what to suggest you. See, even though the company hired you without having a knowledge that you are under OPT, YOU know that your OPT is only valid until December. You were legel when they hired you...

If you stay at that company, later you may have problem with your paperwork; trying explaing to USCIS what you were doing in the country after your OPT ended is not an easy thing.
Lie after lie will eventually confuse you, too :)

Why don't you apply for school again for winter semester? That should buy you some time off until you find another job.

:lol: tochno!!! Smilik is right, it is your responsibility. If you keep working you might get into trouble. I fell out of status a while ago and had to reinstate my F-1 status and I am telling you, the International Office screwed up my papers, not me!!! And when I tried to explain, they just told me --- you should know your stuff, if we missed, then you should have come and check, cause you knew you were graduating. So, no matter what you do try to keep your papers right. Otherwise they'll just kick you out.

However, I have one more question. Is it possible to get an H1B from a private individual. Let's say a family wants me to coach their son or babysit him and etc. They would like to sponsor me as well. So would it be possible to do it through them? Or are there certain requirements for the sponsor?

Please , the ones who received an H1B, share your stories with others...

And one more thing, is it true that after residing in the US for 3 years illegally, you can apply and get a Green Card by just paying a fine?

I am not sure about the rest but the part I quoted sounds like a BS :)

Thanks Smilik. It seems like you have lots of knowledge on Green Card and Immigration Laws. And I assume you yourself is a Green Card holder. Could you please share your experience with us or with me, either through posting or "pm"ing. Thanks.

Duh?! :shock: If that was the case I would be like three times citizen of the United States of the-freakishly-easily-obtainable-H-visa holders-of America :lol: :lol:

Dude, you should really read some stuff about immigration. Check out the thread opened by The Reaper about immigration. They passed some law about illigal immigrants but I do not think it will work that easy though. Do not think that you can get working permit easily, unless you are genius or computor geek of some kind.

from my experience INS will never look after you if ur salary does not reach 100 grand a year. i never had a permit but had worked more than 2 years. i don’t make legally even close to 60 k a year so they never knock my door. friend of mine has been working as contractor for company more then 3 years and makes 2 g a week and sure he gets a check but never had any problem with Tax guys :)
It may cause a problem when you apply for citizenship or something like that but I don’t think they say hey you are a bad boy!
So pay your taxes you will be fine!

I think you have to have a diploma (like medical somthing, nursin)to get a H1 via workin as babysit or homeattendant or if you take care of seniors.
