my current situation is as following: i came with J1, and before expiration of visa i applied for B2. And now after 4 months of expiration, my case is still in pending. though, i have to go back to Tashkent and get at Embassy F1 visa in order to come back to school. do you people think there any chance to succeed this in Tashkent while leaving the USA after expiration of I-94 but having confirmation number of status change?
i really appreciate your opinion.


What's your opinion?? Can you share with your experience and give some advice?

As a J1 student u have to return to the uzbekistan and stay there 2 years,but as soon as you have applied to change your status (it will take min 6 months so make sure that you in status now.If not do not go to Uzbekistan it will be very difficult to get visa there.If your purpose is staying in US just live here even as a nelegan or go to Canada to get F1 visa.If I did not understand your situation write details it will be helpfull.

Below is the Question to be answered in USCIS form I-485 to change status in the United States to permanent resident.

"Have you ever been a J nonimmigrant exchange visitor who was subject to the two-year foreign residence requirement andhave not yet complied with that requirement or obtained a waiver?"


My question: how do you obtain a waiver???

As a J1 student u have to return to the uzbekistan and stay there 2 years,but as soon as you have applied to change your status (it will take min 6 months so make sure that you in status now.If not do not go to Uzbekistan it will be very difficult to get visa there.If your purpose is staying in US just live here even as a nelegan or go to Canada to get F1 visa.If I did not understand your situation write details it will be helpfull.

this won't be a good decition to do. I had a J1 too. But, I went back and got F1 without any problem. I would suggest u to go back and apply in legal way.

lekin baribir 2 yil requirementiz bo'ladi. bu F1 visa olishizga halaqit bermidi. eshitishimcha if u are coming to study, u can fulfil 2 years req after u finish ur degree. lekin afsuski, waiver haqida bilmayman

My friend did the same thing, he applied to change his status from J1 to B1/B2 it took him 3 month and 1000 USD for immigration lawyer

Men J-1 bilan kelganman birinchi bor USA ga keyin bir yildan keyin J-1 tugagandan so`ng extension of stay olganman 6 oyga u ham tugagandan keyin B-1 B-2 tourist visaga hujjat topshirganman visa tugashiga 3-4 kun qolganda,ho`sh keyin B-1 B-2 ga javob kelguncha uyga qaytib ketganman lekin visa tugaganigan 3 oydan keyin. Men USdan qaytib ketganimdan keyin B-1 B-2 ga javob kelgan oradan 2 oy o`tgach lekin men uni ishlatmadim chunki huddi o`sha paytda H1B ga hujjat topshirayotgan edim. Aprelda H1B ga hujjatni topshirdim va Noyabrda approval oldim keyin elchihonadan visamni oldim!
Ho`sh endi menda ham "Subject 212E" edi lekin uni elchihonada to`g`rilaganman!
Yana nimani aytay sizlarga ha J-1 hammasi ham "Subject" bo`lmaydi va 2 yil turishi shart emas o`z davlatida.
Waiwerni olish uchun USCIS ni sitega kiring hamma malumot bor ko`pincha ko`pchilik "No objection" ni olishadi!
Hozircha hammelarni savolilarga javob bo`ldi deb o`ylayman!:D

First off,it depends on who sponsored you while you were on J1 status.If it is government of Uzbekistan,you need to be getting a letter from Ministry of Foreign Affairs addressed to Uzb. Embassy,which in turn will address Dept. of State.
You will have to do the same thing if you were sponsored by US government,in other words your administrator has to waive the 212-E section.
Obtaining a waiver is a very complicated and long process and you need to be getting some consultation from an experienced attorney.

Resident,you should know that students who have been on J1 visa can go ahead and apply for F1/H1b visas right after graduation or expiration of their J1 visa.Two year home presence requirement issue will arise when you apply for permanent residence.Immigration officers will ask you to show them proof that you either served or waived the requirement.Thus,getting H1b (worker visa) does not mean that your requirement is waived.

Generally,chances of getting student (F1) visa will be lower due to the fact that your friend applied for a "change of status".But as long as his/her status is pending,it means she is legally allowed to stay in the country.She will not be considered out of status.Your friend needs to get the Notice of Action letter from USCIS and show it at US consulate in Tashkent.

It would be best if he could wait for his decision from USCIS.If his case gets approved,he will have a letter from them.I just recalled a very similar case.A friend of mine did file for B1/B2 visa extension and had gone back to Tashkent to apply for F1 visa before he got approval from USCIS.He got his F1 visa stamp,came back to US and received a letter of approval from USCIS.Thus,your friend has chances to get his visa.No one can guarantee that he will be issued a visa but he is not in violation of any visa regulation so I do not see any problems with obtaining his visa.

Not all of the J-1 visas are subject to 212(e). Those who came to states with work and travel, for exmp. are not :)

Yes I wrote about it in my previous post.
I was subject 212E in my passport stamp but nobody sponsored me when I came to US first time so when I applied for H1B I just showed proof to consul and he made changes in my records!

What is the best way to get so called Green Card while being on J-1 visa status? In this case it's not subject to 2 year rule.

Adjustment of Status. That easy :) All you will have to do is mail your documents to USCIS with all the fees. They will adjust your status.

Well in my case it did not work the consul told me that he cannot issue a visa if I cannot proof that I am not subject 212E plus one of my friends got his H1B before me when I was still J-1 holder and when he applied for H1B he was being asked visa waiver then he applied and got it in 4 months!

Есть ли возможность подачи зачвлений а permanenant residence????Вы не можете подавать заявление на перманент резиденсе, так как у Вас нет визы H-1. Согласно правилам программы WT2007, Вы обязаны вернуться домой после завершения данной программы.

aziz dotlar, hammaga bir savolim bor bilganlar bo'lsa javo berishinglarni iltimos qilaman. Men birinchi bor US ga kelganimda J-1 visa bilan kelganman, through Work and Travel, then I have applied for B-1/B-2 now it is still pending, so do you think I can return to my home country which is to KYrgyzstan and somehow come back to US.

adashmasam, menga endi KG posolstvasi visa bermasa kerak, chunki over there I have violated the regulations in KG, if even I am not in violation of visa regulations in US.

I just got approval on my case, I chaged from b1/b2 to F1, attending to language school, in feb 15 I have a TOEFL exam, after that applying to College, during this period what do you think can i get F1 Visa in Canada??? Is there a mark 'prospective student' on your B1/B2?

during this period what do you think can i get F1 Visa in Canada???

Обычно по категории Trainee, обладатель J-1 визы должен вернуться домой после окончания программы и для многих стран не снимается 2 years Home Residence. Вы уверены, что условие Вас не касается? Еще раз внимательно посмотрите на визу в паспорте, а также на Form DS-2019.
Если его нет, можем рассмотреть некоторые варианты для Вас.

Can you PM me giving all details concerning your first date of enter the US on J visa and original visa's expire date as well as date of your application for extension of ur status and other important data from your point of view that make the "whole picture" clean. Then I may give you some tips to apply for COS (Change of Status) or a temporary visa from outside the US provided 2 year home residence rule does not refer to you.
